KEMPERSPORTS TOUR OF TEXAS PROGRAM TERMS

PLEASE READ THESE TERMS CAREFULLY. BY PARTICIPATING IN THE KEMPERSPORTS TOUR OF TEXAS PROGRAM, YOU AGREE TO BE BOUND BY ALL TERMS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, YOU CANNOT PARTICIPATE IN THE PROGRAM.
GENERAL
The KemperSports Tour of Texas Program (the “Program”) is one way in which KemperSports rewards and thanks loyal customers for patronizing our properties, booking tee times via our property websites, and playing great golf at our participating facilities (each a “Facility”). Program members are able to earn and accumulate stamps that can be used to enter promotions and redeemed for rewards and/or other program benefits.
These Terms apply to your participation in the Program. These Terms do not alter in any way the terms or conditions of any other agreement you may have with KemperSports or any of our Facilities for golf, products, services or otherwise. KemperSports reserves the right, at any time and in its sole and absolute discretion, to change, modify and/or eliminate the Program and/or these Terms or any policy pertaining to the Program without notice to you. Any changes or modifications will be effective immediately upon posting the revisions to www.kempersports.com and/or the Program mobile app and you waive any right you may have to receive specific notice of such changes or modifications. Your participation in the Program confirms your acceptance of these Terms and any such changes or modifications; therefore, you should review these Terms and applicable policies frequently to understand the terms and conditions that apply to the Program. If you do not agree to the Terms, you agree to stop participating in the Program. KemperSports reserves the right to terminate your account and/or your participation in the Program if it determines in its sole discretion that you have violated these Terms or any KemperSports or Facility policy, you have more than one (1) account, or that the use of your account or any of our products, services or Facilities is unauthorized, deceptive, fraudulent or otherwise unlawful or harmful to others.
By participating in this Program, you agree to release, discharge and hold harmless KemperSports, and its respective parents, affiliates, subsidiaries, retailers, distributors, suppliers, advertising and promotion agencies, and any other individuals engaged in any way in the development, production, distribution or execution of this Program, and the respective directors, officers, and employees of the foregoing from any liability, claims, losses and damages arising out of or relating to your participation in this Program. By participating in this Program, you expressly understand and agree that KemperSports shall not be liable for any direct, indirect, incidental, special,consequential, or exemplary damages, arising out of or related in any way to your participation in this Program.
There are no membership fees associated with the Program. Rewards accumulated under the Program are promotional, have no cash value, and cannot be redeemed for cash or cash equivalents. Your Program rewards and your account under the Program are personal to you and may not be sold, transferred, or assigned. You may have only one (1) Program membership account.
PRIVACY
By participating in the Program, you consent for KemperSports to send you communications through, among other means, your designated email address, and the Program mobile app regarding your participation in the Program. You also have the opportunity to opt-in for other marketing communications relating to, among other things, KemperSports products, services, facilities and other offerings we believe you would be interested in. Please refer to the KemperSports Privacy Policy located at http://www.kempersports.com carefully to understand how KemperSports collects, uses, and discloses information about customers. Please refer to and follow the opt-out procedures described in the KemperSports mobile app and/or other communications if you wish to cease receiving communications from KemperSports regarding the Program and/or other marketing communications.
HOW TO ENROLL IN THE PROGRAM
Download the KemperSports Program mobile app through an App store. You can also enroll online through your web browser. Follow the prompts to create a Program membership account. By enrolling you are opting into KemperClub and will receive KemperClub emails. You can choose to unsubscribe at your discretion.
PROGRAM MECHANICS
Once you are a member of the Program you will be entitled to receive a digital stamp on your digital card for booking a tee time directly on a Facility website and playing a round of golf at each of the five Facilities during April 16 – December 31, 2024(the “Program Period”). To earn a stamp, no other discount or promotion may apply to your booking, and you must have your name and email on the tee sheet. Stamps must be credited on the day of play, so please make sure that you book directly through a Facility web site and are eligible to be credited with your stamp when your round is paid for or completed.
Stamp Mechanics: In order to be credited with a stamp and the associated reward, participants book directly through a Facility website and be on the Facility tee sheet on the day of play.
Stamps have no monetary value but when you have achieved the number of stamps below you are entitled to receive the following rewards:
Welcome Reward: Tour of Texas logoed poker chip ball marker. Reward must be redeemed at a participating Facility.
Stamp 1: Welcome Reward is awarded. If the player is already a member of the Program and did not previously receive a Welcome Reward, the player will receive a Tour of Texas Logoed poker chip ball marker.
Stamp 2: Tour of Texas logoed Titleist® golf hat.
Stamp 3: Sleeve (3) of Titleist® Pro V1® golf balls. Entry to win an exclusive trip to Streamsong Resort.
Stamp 4: Golf Cart Reward. (One round for Program member only. Value not to exceed $25. Greens fee purchase required.) Entry to win an exclusive trip to Streamsong Resort.
Stamp 5: Titleist® Vokey SM10 Wedge. Entry to win an exclusive trip to Streamsong Resort.
Reward Conditions: Except for the Streamsong trip, rewards must be redeemed at a Facility during the Program Period. All redemptions are subject to verification. In the event that a property does not have the logoed Titleist® hat on property, KemperSports and the Facilities may coordinate with the player to ship the Titleist® hat to the player at a later date. The Titleist® Vokey SM10 reward is available while supplies last and will only be rewarded after completion of the Program. Sponsor reserves the right to substitute a reward with one of equal or greater value if advertised rewards become unavailable for any reason. KemperSports and the Facilities will coordinate with the player to administer the Titleist® Vokey SM10 to the reward recipient at the end of the Program Period.
Other Program Benefits and Rewards: KemperSports may also offer additional promotions, such as contests in connection with the Program and may choose in its sole discretion to offer other Program benefits, rewards, offers or contests at any time with or without notice. We will endeavor to update the app and announce such additional offers on www.kempersports.com as well.
HOW TO WITHDRAW FROM THE PROGRAM
You may withdraw from the Program at any time, and if you downloaded the app, you can delete the Program app from your mobile phone. Once you withdraw from the Program, stamps will no longer be valid, and rewards may be voided, and you will be no longer eligible for Program benefits.

KEMPERSPORTS TOUR OF TEXAS OFFICIAL CONTEST RULES – STREAMSONG RESORT GOLF EXPERIENCE GIVEAWAY
No purchase is necessary to enter or win.
1. Eligibility: Contest (the “Contest”) is open only to those who join the KemperSports Tour of Texas Program. Joining the KemperSports Tour of Texas Program is free. Earn entries after joining the program, opting in to email communications, having their name and email on the tee sheet for each round played within program, and receive one (1) entry for per qualifying rounds three through five at a participating facility, for a total of up to three (3) entries. playing one round of golf at participating properties, Entrants must be KemperSports Tour of Texas members who are 21 years of age as of the date of entry. The contest is only open to legal residents of the United States and is void where prohibited by law. Employees of Kemper Sports Management, LLC, their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers, and their immediate family members and/or those living in the same household of each are not eligible to participate in the Contest. The Contest is subject to all applicable federal, state, and local laws and regulations as well as the terms and conditions of the KemperSports Tour of Texas Program. Void where prohibited.
2. Agreement to Rules: By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Sponsor, as final and binding as it relates to the content. The Contest is subject to all applicable federal, state, and local laws.
3. Contest Period: Contest Entries for playing rounds of golf may be received starting on April 16, 2024, and ending on December 31, 2024(the “Contest Period”).
4. How to Enter: The Contest must be entered by enrolling in the KemperSports Tour of Texas program, providing email information and (a), having their name and email on the tee sheet for each round played within program and receive one (1) entry per qualifying rounds three through five at different participating facilities consistent with the Tour of Texas Program terms, for a total of up to three (3) entries during the Contest Period. The entrant must fulfill all contest requirements and remain a member in good standing of the KemperSports Tour of Texas program as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Sponsor. You may not enter by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility or disqualified at the sole discretion of Sponsor; or (b) sending a 3x5 card with your KemperSports Tour of Texas Program name, email, membership number and Facility name in a postage paid envelope to KemperSports
500 Skokie Boulevard, Suite 444, Northbrook, Illinois 60062 USA., Attn: Tour of Texas Streamsong Experience. One entry per envelope. Maximum of three (3) total entries per person/member regardless of means used to enter.
5. Prizes: One winner will receive a package for two people for a two-night stay (double occupancy), two rounds of golf, including caddies, and $250 per person for food and beverages (alcoholic beverages excluded). The two-night stay is restricted to weekdays during the “in-season” time frame as determined by the Sponsor. The specifics of the prize shall be solely determined by the Sponsor. Approximate Retail Value of Prize is $5,000. No cash or other prize substitution permitted except at Sponsor's discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. Acceptance of prize constitutes permission for KemperSports to use winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law. Prize must be redeemed through Sponsor by December 31, 2025. Reservations are subject to availability. Additional terms and restrictions may apply. All off-premises expenses, including travel expenses to and from destination property are the responsibility of the winner and his/her guests.
6. Odds: The odds of winning depend on the number of eligible entries received.
7. Winner selection and notification: Winner of the Contest will be selected in a random drawing among eligible entries under the supervision of the Sponsor to take place on or about January 15, 2025. Winner will be notified via email to the email address they entered the Contest within approximately five (5) days following the winner selection. Sponsor shall have no liability for a winner's failure to receive notices due to winners' spam, junk e-mail or other security settings or for winner’s provision of incorrect or otherwise nonfunctioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within three (3) days from the time award notification was sent, or otherwise fails to provide evidence of eligibility and/or timely return a completed and executed declaration and release as required, prize may be forfeited, and an alternate winner may be selected. Guests must be twenty-one (21) years of age unless winner is parent or guardian of guest. Guests may be required to sign liability and publicity releases to participate in prize use. Round of golf subject to all Sponsor and facility rules.
The receipt by winner of the prize offered in this Contest is conditioned upon compliance with any and all federal and state laws and regulations. Any violation of these official rules by any winner (at Sponsor’s sole discretion) will result in such winner’s disqualification as winner of the sweepstakes and all privileges as winner will be immediately terminated.
8. Rights Granted by you: By entering this Contest you understand that Sponsor, anyone acting on behalf of Sponsor, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner's name, portrait, picture, voice, likeness, image or statements about the Contest, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.
9. Terms: Sponsor reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Contest should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or any other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Contest. In such case, Sponsor may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates these Terms & Conditions.
Sponsor has the right, in its sole discretion, to maintain the integrity of the Contest, to entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by contest rules; or the use of bots, macros or scripts or other technical means for entering.
Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the contest may be a violation of criminal and civil laws and should such an attempt be made; Sponsor reserve the right to seek damages from any such person to the fullest extent permitted by law.
10. Limitation of Liability: By entering you agree to release and hold harmless the Sponsor and their respective subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in the contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Contest; (v) electronic or human error which may occur in the administration of the Contest or the processing of entries.
11. Disputes: This sweepstakes is governed by the laws of the United States of America and Illinois, without respect to conflict of law doctrines. As a condition of participating in this Contest, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Illinois having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Contest), and participant further waives all rights to have damages multiplied or increased.

13. Winner Announcement: The winner will be announced on www.kempersports.com on or about January 15, 2025.
